Most countries require 183 days per year of physical presence to establish tax residency. Cyprus has a second route: the 60-day rule. It is designed for internationally mobile individuals who cannot or do not want to spend more than half the year in any single country.
It is not a loophole. It is a legitimate provision in the Cyprus Income Tax Law. Used correctly, it establishes full Cyprus tax residency, including access to non-dom status.
The Four Conditions
You must meet all four conditions in the same calendar year:
- Spend at least 60 days in Cyprus during the calendar year
- Not spend more than 183 days in any other single country
- Not be a tax resident in any other country during that year
- Have a genuine connection to Cyprus through a Cyprus company, employment in Cyprus, or a permanent home (owned or rented) in Cyprus
The fourth condition is the one most guides skip. Simply visiting for 60 days is not enough. You need a real business or property connection established in Cyprus before the end of the tax year.
People assume the rule works automatically once they arrive. It does not. You must actively manage your day count, avoid crossing 183 days in any other country, formally exit your home country's tax system, and have the Cyprus connection in place before year end.
How It Connects to Non-Dom Status
Once you establish Cyprus tax residency under the 60-day rule, non-dom status follows automatically if you have not been a Cyprus tax resident in the previous 10 years. This gives you 0% tax on worldwide dividends and interest for up to 17 years, from day one of your Cyprus tax residency.
